Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not download, install, or use the App.

User Accounts

• - You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the App.
• - You are responsible for creating and maintaining a secure password for your account.
• - You are responsible for all activity that occurs under your account.

User Responsibilities

Workers:

• - You are responsible for accurately representing your skills, experience, and qualifications.
• - You are responsible for complying with all applicable laws and regulations related to your work.
• - You are responsible for obtaining any necessary licenses or permits for the work you perform.

Employers:

• - You are responsible for accurately describing the work you need done and the qualifications required.
• - You are responsible for complying with all applicable labor laws and regulations.
• - You are responsible for ensuring a safe work environment for Workers.

Machine Owners:

• - You are responsible for accurately describing your Machines and their condition.
• - You are responsible for ensuring your Machines are safe for operation.
• - You are responsible for complying with all applicable laws and regulations related to the rental of your Machines.

Input Buyers:

• - You are responsible for verifying the quality and suitability of any agricultural inputs purchased through the App.

Loan Applicants:

• - You are responsible for providing accurate and complete information in your loan application.
• - You are responsible for complying with all terms and conditions of any loan you receive through the App.

Market Sellers:

• - You are responsible for ensuring the quality and compliance of the agricultural produce you sell through the App.
• - You are responsible for complying with all applicable laws and regulations related to the sale of agricultural produce.

Platform Usage

• - You may not use the App for any illegal or unauthorized purpose.
• - You may not post any false, misleading, or defamatory information on the App.
• - You may not interfere with or disrupt the use of the App by others.

Transaction Fees

AMSHA NEXT GEN PRIVATE LIMITED may charge fees for certain transactions on the App, including but not limited to commissions on sales of agricultural inputs, service fees for loan processing, and potential fees for connecting users with markets. These fees will be clearly displayed before you complete a transaction.

Disclaimer of Warranties

The App and Services are provided "as is" and without warranties of any kind, express or implied. AMSHA NEXT GEN PRIVATE LIMITED disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

AMSHA NEXT GEN PRIVATE LIMITED shall not be liable for any damages arising out of or in connection with your use of the App or Services, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages.

Indemnification

You agree to indemnify and hold harmless AMSHA NEXT GEN PRIVATE LIMITED from any and all claims, losses, damages, expenses, and liabilities (including attorneys' fees) arising out of or in connection with your use of the App or Services.

Termination

AMSHA NEXT GEN PRIVATE LIMITED may terminate your access to the App at any time, for any reason, with or without notice. You may also terminate your account at any time.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

Dispute Resolution

In the event of any dispute, difference, claim or question arising out of or in relation to or in connection with the Agreement touching any matter in connection with these Terms shall be referred to arbitration by a sole arbitrator to be appointed by the Company, to be conducted as per The Arbitration and Conciliation Act, 1996. The venue of the Arbitration shall be Bangalore. Nothing herein contained shall bar Company’s right to obtain injunctive relief against threatened conduct that will cause it loss or damages, under the usual equity rules, including the applicable rules for obtaining restraining orders and preliminary injunctions.
